ORGANIZER. 

The Contest is held Balm Beach Insider, which is owned by 11417304 Canada Inc. operating as Baygirl Media (individually  and collectively the "Organizer" or the "Contest Organizer").

CONTEST PERIOD. 

The Contest will run during the following period - July 1, 2023 to September 1, 2023 (“Contest Period”) IN ONTARIO :

Date: SEPTEMBER 1, 2023

Time: 11:59 P.M.

 

The contest is void where prohibited or restricted by law.

ELIGIBILITY 

The Contest is open to residents of the province of Ontario of any age, however residents under the age of 18 must submit parental consent that will be used to cover all images entered by the minor. Parental consent form: Please request a parental consent form by emailing hello@balmbeachinsider.com . Include in the subject line PARENTAL CONSENT FORM REQUEST The consent form must be emailed and on file prior to first entry.

 

All photos must: 

• Be photographed after June 20, 2023 

• Been photographed on Georgian Bay or from one of the townships that border its shores e.g. Tiny, Tay, Midland, Penetang, Wasaga Beach, Georgian Bay etc.

• Be original work, taken by the entrants. No third party may own or control any materials the photo contains, and the photo must not infringe upon the trademark, copyright, moral rights, intellectual rights, or rights of privacy of any entity or person.

• Be in its original state and cannot be altered beyond cropping for composition/ aspect ratio, adjustments to exposure, highlights/lowlights. Composite Images or images that have been altered including but not limited to removing, adding, reversing, or distorting subjects within the frame will be removed from the contest, stripped of any prize(s), and banned from entering future contests.

• Submitted as a  lower resolution JPG format. Maximum size 1 Meg. However the photographer must keep a high resolution JPG or Tiff format for printing by the sponsor, should they win one of the prizes on offer.

• Submitted via the official contest channel and the entry fee paid. Entries not submitted through the proper channel will be deleted.

• Submitted by the weekly assignment deadline. Submissions for a weekly assignment deadline will not be accepted once the deadline lapses.

 

The following are excluded: directors, officers, executives, employees, agents and  representatives of the Contest Organizer or affiliates, of Facebook if Contest is run on  Facebook/Instagram and What’s App, advertising and promotional agencies, suppliers of prizes, sponsors,  goods and services related to this Contest, as well as the individuals with whom they reside  (whether related or not). 

 

ENTRY FEE AND SUBMISSION 

Entry fees are paid prior to photo submission.  The fee is $5.00 per photograph to be submitted in a given week for the current assignment challenge. Proceeds after processing charges are donated to the Georgian Bay Food Network. 

 

Payment of the entry fee, triggers an email with a link to a Google Form. Participants use the Google Form to complete their entry and upload their photo(s) for a given weekly assignment challenge. Each week of the contest has its own Google Form  that collects only those submissions for that specific week. Submissions uploaded after the deadline will be removed.

 

An entry fee is paid ONLY when a participant intends to submit a photo(s). Participants may enter a single photo for a specific weekly assignment challenge, multiple photos, skip weeks etc. For example, a participant may enter a single photo for the assignment challenges in weeks 2 and 5 and chose to enter 3 photos in the assignment challenge for week 8.

 

PRIZES 

All prizes provided by the contest sponsor, The Gallery Printers. Each winning print includes a review of the aspect ratio and screen detail for any recommended touch-ups before printing. Packed flat in acid-free paper ready for pick-up at The Gallery Printers Lafontaine location or shipped to your home. Shipping extra.

• Photo of the Week. each weekly photographer whose image moves forward into the finals will win an 8” X 12” archival-quality giclee print on Vibrance Luster paper.

• Participant Thank You Coupon. All participants receive a savings coupon from The Gallery Printers for 12” X 18” archival-quality giclee print on Vibrance Luster for $22** + HST (a savings of $10.00). 

• Conditions for prizes. All prizes are furnished after winner announcements in late September 2023. The prizes are subject to the sponsor’s terms and conditions of  use. Additional restrictions may apply. The Organizer bears no liability relating to the prize once it is ready for pick-up.

 JUDGING 

The Photo of the Week along with two photos identified as honourable mentions will be determined by the Organizer’s panel of 3 judges. All decisions are final. The Organizer  reserves the right to disqualify any entry that is deemed inappropriate or does not conform to stated contest rules.

Each week, both the image selected as the Photo of the Week and two images chosen as honourable mentions will be promoted on the Balm Beach Insider’s social media. By entering the contest, entrants agree that photos submitted can be used by the Organizer for advertising purposes.

Public Vote for the Favourite Photo of the Week - Sep 9-15, 2023

CLAIMING PRIZES 

The winner(s) will be contacted via the email address provided during entry. If no response is received after three (3) business days, the prize will go to the next level winner and/or a new winner  selected. The previous winner will forfeit all rights to the prize.

• The prize must be collected by the winner and is non-transferable.

• The winner must provide photo ID, upon request and in a timely fashion.

• The winner must provide a high-resolution JPG or Tiff format of the winning photo to our contest sponsor The Gallery Printers and follow the Sponor’s instruction to upload.

• All winners must pick-up their prize at the Lafontaine location of the Sponsor or make arrangements at their own expense to ship their prize to their preferred location.

GENERAL CONDITIONS 

ANY ATTEMPT BY AN ENTRANT OR OTHER PERSON TO DELIBERATELY  DAMAGE A WEB SITE, EQUIPMENT, APPLICATION OR TECHNOLOGY USED FOR THE  CONTEST OR INTERFERE WITH THE LEGITIMATE OPERATION OF THE CONTEST  CONSTITUTES A VIOLATION OF CIVIL AND CRIMINAL LAWS. THE ORGANIZER  RESERVES THE RIGHT, IN SUCH CASE, TO REPORT SAID PERSON TO THE  AUTHORITIES AND DEMAND FROM SAID PERSON ALL DAMAGES ALLOWED BY LAW. 

• Declaration and Release Form. By entering or attempting to enter this Contest, any selected  entrant releases and holds harmless the Contest Organizer, its parent company, any company,  corporation, trust or other legal entity controlled by or affiliated with them, Facebook in the case of a Facebook/Instagram  contest, their advertising and promotional agencies, the providers of prizes, goods or services  for the Contest, as well as their respective directors, officers, associates, employees, agents,  representatives, successors and assigns (collectively the “Released Parties”) from any and  all liability relating to the Contest (participation, conduct, advertising, rules, etc.) or the prize (claim, use, etc.). In order to be declared a winner, selected entrants will have to sign a  Declaration and Release Form confirming their compliance with the Contest Rules and this  release of liability in favour of the Released Parties. 

• Limitation of liability. Without limiting the generality of the above release, the Released  Parties disclaim any and all liability for any of the following: (i) any misprint (or other error) found  in the offer or documents regarding the administration of the Contest, including, but not limited  to, errors in the promotion, official Contest Rules, announcement of the winner(s), awarding of  the prize(s), or any malfunctioning of or problems or technical difficulties with any networks,  phone lines, SMS systems, computer component, software or communications line, loss or lack  of network communications, or any transmission that is faulty, incomplete, incomprehensible or  erased by any computer, server or service provider or software, virus, bug, PC failure, software  and hardware configuration, or failed transmission of any email or other communication to the  Contest Organizer or to an entrant for whatever reason, including any network congestion or  web site crash that may limit a person’s ability to participate in the Contest; (ii) late, lost, stolen,  damaged, undelivered, improperly delivered, incomplete or inaccurate entries; (iii) failure to  receive entries due to transmission problems or any other technical failure, including, but not  limited to, the malfunctioning of any network, server, service provider, hardware or software,  whether attributed to the sender or the recipient that may limit or prevent a person’s participation  in the Contest; (iv) any damages that may be caused, directly or indirectly, in whole or in part,  notably to entrant’s or other person’s system or device, by any Web page, software or other  download or by the transmission of any information concerning the Contest.

• Web site. The Contest Organizer does not guarantee that access to or use of the Balm Beach Insider Facebook page/Instagram accounts/platforms will be uninterrupted during the Contest Period or error-free. 

• Contest cancellation, suspension or modification. The Organizer reserves the right, at its  sole discretion, to cancel, terminate, modify or suspend the Contest, in whole or in part, should  human intervention or an event occur, such as a system problem with registering all entries,  that could alter or affect the administration, security, impartiality or conduct of the Contest as  provided in these Contest Rules. 

• Termination of participation in the Contest. Should the Contest have to close, in whole or in  part, before the end of the Contest Period, the Contest Organizer may, at its sole discretion,  proceed with a Public vote  from among the eligible entries duly registered during the Contest  Period or, as the case may be, up to the date of the event ending this Contest. 

• Personal information. By participating, entrants consent to the collection, use and disclosure  of their personal information by the Organizer, its affiliates, the prize sponsor and/or their authorized agents for the purpose of administering the Contest and awarding prizes. In accepting a prize, a winner authorizes the Contest Organizer, its affiliates and their  representatives to use, if need be, his/her name, address (city, province), voice, statements,  photo, likeness and other representations and recording for advertising purposes in all media  including, but not limited to, the Internet, without further notice or compensation. Each entrant may be required to sign a document to that effect. 

• Copyright/Intellectual property. The entrant agrees to provide, upon  request, proof that he/she holds the copyright/intellectual property rights to the Work and  indemnify and hold harmless the Contest Organizer from and against all claims, actions,  proceedings arising from any use of the Work. 

• Ownership. All Contest-related information and documents, including but not limited to, entry  forms, Declaration and Release Forms, information of a technical or  operational nature or regarding designs, information systems, software, logos, trademarks and  intellectual property are and remain the sole property of the Contest Organizer and will in no case be returned to participants. 

• Entrant identification. For the purpose of the Contest Rules, the entrant is the person whose  name appears on the entry form, and the prize will be awarded to this person if he/she is  selected and declared a winner. In the event of a dispute regarding the identity of the person  who submitted an entry form, it will be deemed to have been submitted by the authorized  account holder associated with the email address provided at the time of submission.  “Authorized account holder” is defined as the natural person to whom an email address is  assigned by an Internet or online service provider, or other organization responsible for  assigning email addresses for the domain associated with the submitted email address.

• Contest Organizer’s Decisions. Any decision by the Contest Organizer or its representatives  regarding the Contest is final and without appeal.

• Miscellaneous. By entering the Contest, entrants agree to be bound by the Contest Rules and  the decisions of the Organizer, which are final and without appeal in all matters, including, but  not limited to, decisions regarding entry eligibility or disqualification and awarding of prizes. The  Contest is subject to all applicable laws and regulations. Only selected entrants will be  contacted. If a section of the Contest Rules is declared invalid or unenforceable by a court of  competent jurisdiction, that section shall be considered invalid; all unaffected sections will remain valid.

• Posting of winners’ name. Within sixty (60) days of the draw, the Organizer has the right to post the winners’ names and photos on @balmbeachinsider Facebook and Instagram accounts as well as on www.balmbeachinsider.com  This information shall last up to one (1) year.
